1. Acceptance of terms
By accessing or using BotChata ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the Service.

3. Description of service
BotChata provides an AI chatbot platform that allows website owners to create chatbots trained on their website content. The chatbot is delivered as an embeddable JavaScript widget. The Service includes content indexing, AI-powered chat, conversation history, and related features. The Service is supplied remotely in electronic form over the internet; no physical goods are shipped.
4. Account registration
You must register an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. You agree to provide accurate and complete information during registration.
5. Acceptable use
You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) process or store illegal content; (c) infringe on the intellectual property rights of others; (d) send spam or unsolicited messages; (e) attempt to gain unauthorized access to our systems; (f) use the Service to harass, abuse, or harm others. We reserve the right to suspend or terminate accounts that violate these terms.
6. Your content
You retain all rights to the website content you index through our Service. By using the Service, you grant BotChata a limited license to crawl, store, and process your content solely for the purpose of providing the chatbot functionality. You represent that you have the right to index the content you provide.
7. Pricing and payment
Current pricing is published in the Pricing section at botchata.net. For customers in Ukraine, prices are shown and charged in Ukrainian hryvnia (UAH) via the WayForPay payment gateway using Visa and Mastercard. For international customers, payment is processed by Paddle in US dollars (USD) or euro (EUR) depending on the payer's country. Paid plans are billed monthly in advance and renew automatically until cancelled; you may cancel at any time from your billing settings. No acquiring fees are added on top of the price shown — they are borne by us. We reserve the right to change pricing with 30 days' notice; changes do not affect an already-paid period.
8. Service provision
Access to a paid plan is activated automatically as soon as the payment is confirmed (typically within a few minutes) and lasts for the paid billing period (one month). The Service is delivered electronically; nothing is shipped physically. If access is not activated within 24 hours of payment, contact us using the details in section 2.
9. Refunds
You may request a refund within 14 calendar days of payment if the Service was not actually used during that period (no site indexing performed and no chatbot messages sent beyond the free allowance). Where the Service was used during a billing period, that period is not refundable, as the service has been rendered. Regardless of the above, if the Service was unavailable due to a technical fault on our side that we did not remedy within a reasonable time, the affected period is refunded in full. To request a refund, email support@botchata.net with your account email and the payment date. We review requests within 3 business days. Refunds are issued to the same payment card used for the original payment; crediting takes 1–30 banking days depending on the issuing bank.
10. Complaints
Complaints and disputes about service quality are accepted at support@botchata.net or by phone at +380677043224. We respond within 3 business days of receipt. The parties will attempt to resolve disputes through negotiation; failing that, disputes are settled in court under the laws of Ukraine.
11. Free plan limitations
The Free plan is subject to usage limits (100 messages per month, 100 pages indexed, 1 website). We reserve the right to modify or discontinue the Free plan at any time with reasonable notice.
12. Service availability
We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our reasonable control.
13. Limitation of liability
To the maximum extent permitted by law, BotChata shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim.
14. Disclaimers
The Service is provided "as is" without warranties of any kind. BotChata does not warrant that the chatbot responses will be accurate, complete, or error-free. AI-generated responses should be reviewed by humans before being relied upon for critical decisions.
15. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be deleted within 30 days. We may immediately suspend or terminate your account if you violate these terms.
16. Governing law
These Terms are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine.
17. Changes to terms
We may update these Terms at any time. We will notify you by email of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
